RESOLUTION 2026-97

Support of a Full, Independent, and Transparent Investigation into the Improper Registration of Non-Citizens to Vote

WHEREAS, the integrity of our elections is fundamental to the democratic process and to maintaining public confidence in our government; and

WHEREAS, on July 21, 2026, the Governor of New Jersey, Mikie Sherrill, announced that approximately six thousand six hundred (6,600) individuals who had indicated that they were not United States citizens were improperly registered to vote as a result of a software error in the New Jersey Motor Vehicle Commission (“MVC”) system between June 2023 and June 2024; and

WHEREAS, Governor Sherrill further stated that a preliminary review found that fewer than four hundred (400) of the individuals newly registered as a result of the error subsequently cast ballots; and

WHEREAS, regardless of whether any individual election was ultimately determined to have been affected, the improper registration of individuals who are not eligible to vote raises serious concerns regarding the accuracy, security, oversight, and integrity of New Jersey’s voter registration system; and

WHEREAS, the public deserves a complete accounting of how this error occurred, how long it remained undetected, what safeguards failed, and what steps will be taken to ensure that a similar failure cannot occur again; and

WHEREAS, the people of New Jersey deserve to know in which counties and jurisdictions the affected individuals were registered, in which elections any ballots were cast, and whether any races or election outcomes may have been affected by those ballots; and

WHEREAS, the investigation should be conducted in a transparent and independent manner, including consideration of a bi-cameral, bi-partisan legislative investigative committee with subpoena power and the ability to question witnesses under oath; and

WHEREAS, the integrity of voter registration should not rely solely upon one agency, database, software system, or automated process, and additional independent safeguards and verification procedures should be adopted to ensure the accuracy of the State’s voter rolls; and

WHEREAS, an independent third-party review and verification process could provide an additional layer of accountability and serve as a check and balance to identify errors, inconsistencies, or improper registrations before they can affect an election; and

WHEREAS, the Sussex County Board of County Commissioners has adopted a resolution calling upon the Governor of the State of New Jersey and appropriate state election authorities to conduct and make public the results of a full and transparent investigation into this matter, and the Township Committee of the Township of Fredon wishes to formally support and join in that call;

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Fredon, County of Sussex, State of New Jersey, that it hereby supports the resolution adopted by the Sussex County Board of County Commissioners and calls upon the Governor of the State of New Jersey and the appropriate state election authorities to conduct and make public the results of a full and transparent investigation into the circumstances surrounding the improper registration of approximately 6,600 individuals who had indicated that they were not United States citizens; and

BE IT FURTHER RESOLVED, that the investigation identify, to the fullest extent permitted by law, the following:

How the registration error occurred and precisely what software systems, procedures, or oversight failures contributed to it;

The dates during which the error occurred and the full scope of individuals affected;

The counties and municipalities in which affected individuals were registered to vote;

The elections in which any affected individuals cast ballots;

The number of ballots cast by affected individuals in each election and jurisdiction;

Whether any affected ballots were cast in elections decided by a margin equal to or less than the number of potentially ineligible ballots cast;

Whether any federal, state, county, or local election results may have been affected or require further review; and

What corrective actions and safeguards will be implemented to prevent similar errors in the future;

BE IT FURTHER RESOLVED, that the Township Committee of the Township of Fredon calls for an immediate suspension of automatic voter registration at every MVC agency and on the MVC website until the integrity of the registration system can be verified; and

BE IT FURTHER RESOLVED, that the Township Committee of the Township of Fredon calls upon the State of New Jersey to establish an independent, third-party verification and auditing process for voter registration systems, operating as an ongoing check on the accuracy and security of the State’s voter rolls, separate and apart from the MVC and its software vendor; and

BE IT FURTHER RESOLVED, that a certified copy of this Resolution be transmitted by the Municipal Clerk to Governor Mikie Sherrill, the New Jersey Secretary of State/Division of Elections, the New Jersey Motor Vehicle Commission, the Sussex County Board of County Commissioners, the Sussex County Clerk, and to the members of the New Jersey Legislature representing the Township of Fredon.

Adopted this 26th day of August, 2026.

CERTIFICATION

I hereby certify the foregoing to be a true and exact copy of a Resolution adopted by the Township Committee of the Township of Fredon at a meeting held on August 26, 2026.
