Resolution 2026-90

Resolution Establishing Policy Regarding the Repair of Curbing and Driveway Apron Transitions in Connection with Roadway Resurfacing Projects

WHEREAS, the Township of Fredon (the “Township”) periodically undertakes roadway resurfacing (repaving) projects as part of its ongoing road maintenance and capital improvement program; and

WHEREAS, prior to and during any such resurfacing project, the Township’s Department of Public Works (“DPW”) will assess drainage conditions and curbing along the affected roadway to determine whether repair or replacement is necessary for proper stormwater drainage, structural integrity, or public safety; and

WHEREAS, curbing found to be damaged, deteriorated, or otherwise deficient to the extent that it materially affects drainage, roadway structural integrity, or public safety shall be repaired or replaced by the DPW as part of the resurfacing project, including depressed curb and curb cuts where such repair or replacement is necessary for proper stormwater drainage; and

WHEREAS, curb cuts, driveway apron transitions (the paved or graded area connecting a private driveway to the roadway) and curbing that is intact and functioning properly, but which a property owner wishes to have repaired, replaced, or altered for aesthetic reasons only, are not part of the Township’s roadway drainage or structural system and do not present a public safety or drainage concern; and

WHEREAS, the Township Committee finds that repair or replacement of curbing, curb cuts and driveway apron transitions for aesthetic purposes, where no drainage, structural, or safety deficiency exists, is not a proper use of Township DPW labor, equipment, or materials, and is properly the responsibility of the individual property owner; and

WHEREAS, the Township Committee desires to formally establish this policy so that property owners, DPW staff, and Township officials have clear and consistent guidance regarding the scope of curbing and driveway apron work to be performed in connection with roadway resurfacing projects;

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Fredon, County of Sussex, State of New Jersey, as follows:

  1. The foregoing recitals are incorporated herein as though fully set forth at length.
  2. In connection with any Township roadway resurfacing project, the DPW shall assess drainage and curbing conditions along the affected roadway prior to or during the project.
  3. Curbing — including depressed curb and curb cuts — that is determined by the DPW to be damaged, deteriorated, or deficient in a manner that materially affects drainage, roadway structural integrity, or public safety shall be repaired or replaced by the DPW as part of the resurfacing project, at Township expense.
  4. Curbing (including depressed curb and curb cuts) and driveway apron transitions shall NOT be repaired, replaced, or altered by the DPW where the request or need is based solely on aesthetic considerations and no drainage, structural, or safety deficiency exists. Any such aesthetic repair, replacement, or alteration shall be the sole responsibility of the property owner, at the property owner’s own cost and expense, and shall be subject to any applicable Township permit requirements.
  5. This policy shall apply to all Township roadway resurfacing projects undertaken on or after the effective date of this Resolution.
  6. This Resolution shall take effect immediately upon adoption.
